By accessing or using the Game, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using the Game on behalf of a minor, you represent and warrant that you are the parent or legal guardian of that minor and agree to be bound by these Terms on their behalf.
These Terms constitute a legally binding agreement between you and us. Your continued use of the Game following any changes to these Terms constitutes your acceptance of the revised Terms.
PenguDoku is a mobile puzzle game (the "Game") available on Android (Google Play Store) and iOS (Apple App Store). PenguDoku is a classic Sudoku puzzle game with multiple difficulty levels (Easy, Medium, Hard, Expert, Master), smart hints, notes mode, daily challenges, and elegant themes. The Game is offered as a free-to-play experience supported by in-app advertising (IAA) — no in-app purchases, no paywalls.
We may modify, suspend, or discontinue the Game, or any part of it, at any time without prior notice. We are not liable to you or any third party for any such modification, suspension, or discontinuance.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Game on a single mobile device that you own or control, for personal, non-commercial use.

The Game uses an anonymous login system. You are not required to create an account, provide an email address, or set up a password. A unique anonymous identifier is generated on your device to associate your game progress and enable data synchronization with our servers.
You are responsible for maintaining the security of your device and the data stored on it. If you uninstall the Game or clear app data without having your progress synced to our servers, you may lose access to your game data and virtual items. We are not liable for any loss of data resulting from your failure to sync or back up your data.
If you switch devices, your game progress may be transferable through our anonymous login system, provided the same platform account is used. We cannot guarantee that progress will be fully transferable across different platforms (e.g., from Android to iOS or vice versa).
The Game displays advertisements served by third-party advertising partners, including but not limited to Google AdMob, Google Ads, Meta Ads, TikTok Ads, Apple Search Ads, AppLovin, Unity Ads, Mintegral, Chartboost, and Meta Audience Network. These partners may use device identifiers and usage data to serve and measure ads in accordance with their respective privacy policies.

The Game, including all content, features, graphics, sounds, music, level designs, character designs, user interface, code, and other materials, is owned by us and is protected by copyright, trademark, and other intellectual property laws.
Trademarks, service marks, logos, and trade names of PenguDoku are our property and may not be used without our prior written consent.
All third-party trademarks, service marks, and trade names are the property of their respective owners.
THE GAME IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR TEAM MEMBERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE GAME, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In no event shall our total liability to you for all damages, losses, or causes of action arising out of or relating to these Terms or the Game exceed the amount you have paid to us for the Game in the thirty (30) days preceding the event giving rise to the liability, or one hundred U.S. dollars (USD $100.00), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless us and the PenguDoku Team from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
You may stop using the Game at any time by uninstalling it from your device.
We may terminate or suspend your access to the Game at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, your right to use the Game will immediately cease, and you may lose access to your game data.
All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to warranty disclaimers, limitation of liability, and indemnification provisions.
These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
We will first attempt to resolve any dispute arising out of or relating to these Terms or the Game through good-faith negotiations. If the dispute cannot be resolved within thirty (30) days, it shall be submitted to final and binding arbitration.
EU/UK consumers: If you are a consumer located in the European Economic Area, the United Kingdom, or Switzerland, nothing in this Section limits any mandatory rights you have under the consumer protection laws of your country of residence, including the right to bring proceedings in your local courts. You may also submit complaints to the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or confidential information.
The Game is not directed to children under the age of 13. If you are under 13, you may not use the Game without the involvement of a parent or legal guardian. By using the Game, you represent that you are at least 13 years old or have obtained parental consent.
We reserve the right to modify these Terms at any time. When we do, we will revise the "Last Updated" date at the top of this page. For material changes, we will provide notice through the Game or through other reasonable means.
Your continued use of the Game after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Game and uninstall it from your device.
